Terms of Use Agreement
"Dating Coach" is a service of Soulmades Pty Limited, ACN
105 574 089 ('Dating Coach'). Dating Coach website is
www.datingcoach.com.au ('Site').
Dating Coach makes the information on this Site, including without limitation, all files, text, graphics, communications, and products available through the Site
('Materials') and all services operated by Dating Coach and third parties through the Site (further referred
to as 'Services'), available for your use subject to the terms, conditions, restrictions and limitations set forth in this document and any changes to this Terms of Use Agreement
('Agreement') that Dating Coach may publish from time to time.
By accessing or using this Site in any way, including, without limitation, registering on the Site, using of any of the Services, searching the Site or merely browsing the Site, you agree to and are bound by the terms, conditions, restrictions and limitations of this Agreement and
Dating Coach's Privacy Policy. Every time you access
the Site, by doing that you confirm your agreement with Dating Coach's Privacy Policy and this Agreement.
Dating Coach may choose to change the terms, conditions and operation of this Agreement anytime, such modifications to be effective upon posting on the Site. By registering on the Site the user waives any rights or claims it may have against
Dating Coach and agrees to comply with Dating Coach's Privacy Policy and this Agreement.
Users are allowed to use the Site if they are 18 years old or older.
Dating Coach reserves the right, in its sole discretion, to refuse the access to the Site to users located in certain countries and to certain individuals, irrespective of their location.
The content available through the Site is the sole property of Dating Coach
and is protected by copyright, trademark and other intellectual property laws. Except as otherwise explicitly agreed in writing,
Dating Coach-owned content received through the Site may be downloaded, displayed, reformatted and printed for your personal, non-commercial use only, through the means of your home computer. Dating Coach' prior written consent.
In a case if you are unhappy with the service or product that you purchased from the Site,
Dating Coach will, at its option, replace or repair it, or refund it, such request to be made not later than
45 days after the purchase date.
Any content posted by you to the Site or to any address of Dating Coach, by electronic or any other means, will become the property of
Dating Coach and by posting any content to Dating Coach you automatically grant, and you represent and warrant that you have the right to grant, to
Dating Coach an irrevocable, perpetual, non-exclusive, world-wide rights to use, display and distribute this content by any means known and to be discovered, and use this content for any purpose whatsoever, without any notice or compensation to you, including without limitation, the using on the Site and preparing derivative works of, or incorporating into other works.
Dating Coach will not be liable to you or anyone else for any use it makes of your submission of any content to
Dating Coach.
You are solely responsible for the use of Materials on the Site. The information contained
on the Site is provided for entertainment purposes only without assuming a duty of care and is not
intended as professional advice. Dating Coach, its affiliates,
advertisers and agents do not warrant any of the information in terms of
correctness, accuracy, timeliness, or completeness. The service is
provided on "as-is" basis by the Site without warranty of any
kind, either expressed or implied, including without limitation
warranties of merchantability and fitness for a particular purpose. To
the extent permitted by the law, Dating Coach, its affiliates,
advertisers and agents disclaim liability for any direct, indirect,
incidental, punitive, special and/or consequential damages or loss of
profits whatsoever which result from any use, or any inability to use
the Materials on the Site. By using of the site you agree to hold Dating
Coach harmless of any claims for possible loss or damage that may arise
in connection with your use of Dating Coach's Site and Services. To the
extent permitted by the law, in cases where Dating Coach supplied
services to you and the liability for those services cannot be excluded
by the law, the liability of Dating coach will be limited by the payment
of the cost to have the services supplied again.
This agreement will be governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Queensland. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement which will continue in full force and effect.
